These Terms & Conditions (“Terms”) govern your access to and use of the websites, phone/SMS/email communications, quote forms, scheduling tools, and services provided by UPLIFT PINNACLE LLC (“UPLIFT PINNACLE,” “we,” “us,” or “our”). By accessing our site or requesting/receiving any service, you agree to these Terms.

1) Service Area — United States Only
We only provide services within the United States. Our current field operations are focused in South Florida (including Miami-Dade and Monroe Counties) and are subject to technician availability and routing. If you are outside our operating area, we may decline or cancel service.
2) Quotes, Estimates & Scope of Work
- Estimates are not final until an on-site assessment confirms conditions, measurements, model selection, permitting needs, and parts availability.
- Written quotes specify the scope of work, materials, pricing, and any warranty that applies. Changes you request (or conditions discovered on site) may require a change order and updated pricing/timeline.
- If permits/inspections are required, timelines and cost may change accordingly.
3) Scheduling, Arrival Windows & Cancellations
- We provide arrival windows (not exact times) and may adjust for traffic, weather, emergencies, or parts delays.
- Customer cancellations/reschedules: Please notify us at least 24 hours in advance. Late cancellations, no-access situations, or missed appointments may incur a trip/diagnostic fee as quoted when booking.
- Our cancellations/reschedules: We may reschedule or cancel for safety, compliance, or parts availability. We will communicate as soon as practicable and offer the next earliest window.
4) Access, Safety & Customer Responsibilities
- You authorize access to the property and represent that you own the premises or have authority from the owner/HOA/landlord.
- Clear the work area of vehicles/storage and keep children/pets away from high-tension components.
- Do not operate a door/opener deemed unsafe by our technician. We may refuse to proceed if conditions are unsafe or non-compliant.
5) Parts, Materials & Product Availability
- We supply new parts/materials unless otherwise stated. Equivalent or superior substitutions may be used if an exact model/color is unavailable.
- Lead times for special orders (e.g., impact-rated or custom glass doors) vary by manufacturer and are outside our control.
6) Permits, Codes & Compliance
- Where required, we will assist with permitting and propose code-compliant products (e.g., HVHZ/wind-load options for South Florida).
- Final approval is issued by the relevant authority; we are not responsible for delays or failures attributable to regulatory bodies or third parties.
7) Pricing, Payment & Invoices
- Prices are in USD and before applicable taxes/fees unless noted.
- Unless otherwise agreed in writing, payment is due upon completion of the specified work. Deposits may be required on special orders.
- We may charge diagnostic/trip fees, after-hours/emergency rates, and restocking for cancelled special orders (if the manufacturer/distributor charges such fees).
- Past-due balances may accrue late charges and collection costs as permitted by law. We reserve all lien and other legal rights to secure payment.
8) Warranties (Workmanship & Manufacturer)
- Any workmanship warranty will be stated on your invoice/quote and applies only to the specific work performed by us, under normal residential use.
- Manufacturer warranties (doors, panels, glass, openers, hardware) are provided by the manufacturer; we assist with reasonable claims where possible.
- Warranties exclude misuse, accidents, alterations by others, lack of maintenance, corrosion from harsh/coastal conditions, and damage from weather/events beyond our control.
- No warranty on components we did not supply/install, or on unsafe systems we decline to service but you operate anyway.

9) Maintenance & Owner Care
Garage doors and openers require periodic maintenance. Follow the manufacturer’s instructions and any care notes we provide. High-tension components (springs/cables) should not be serviced by untrained persons.
10) Photos, Video & Job Documentation
We may take before/after photos or short videos for technical documentation, warranty verification, safety, or training. If used for marketing, we will avoid showing addresses or personally identifying images of people unless you consent or we have a legitimate interest permitted by law.
11) Reviews & Testimonials
If you submit a review/testimonial, you grant us a non-exclusive license to display it (with first name/initial and city only, unless you authorize otherwise). We may edit for length/clarity without altering the meaning.
12) Prohibited Uses
You agree not to misuse our site or services, interfere with operations, attempt unauthorized access, or violate applicable laws/permits/HOA rules. We may refuse or terminate service for unsafe or unlawful conditions.
13) Third-Party Links, Tools & Integrations
Our site may link to third-party sites/apps (e.g., payment processors, scheduling tools). We are not responsible for their content, policies, or availability.
14) Disclaimers
- Services are provided using commercially reasonable skill and care, but no system is 100% fail-proof. Coastal exposure, storms, and normal wear can affect performance/longevity.
- Except as expressly stated in a written quote/invoice, we disclaim all implied warranties to the maximum extent permitted by law (including merchantability/fitness for a particular purpose).
15) Limitation of Liability
To the maximum extent allowed by law, UPLIFT PINNACLE and its owners, employees, and contractors are not liable for any: (a) indirect, incidental, special, or consequential damages; (b) loss of use, income, or data; or (c) damages exceeding the amount you paid for the specific service giving rise to the claim. Some states do not allow certain limitations, so parts of this section may not apply to you.
16) Indemnity
You agree to defend, indemnify, and hold harmless UPLIFT PINNACLE from claims or losses arising out of: (a) your misuse of products/services; (b) unauthorized operation of unsafe equipment; or (c) your breach of these Terms, except to the extent caused by our negligence or willful misconduct.
17) Intellectual Property
All website content, logos, graphics, text, and arrangements are owned by or licensed to UPLIFT PINNACLE and protected by law. You may not copy or exploit them without written permission.
18) Privacy; Communications Consent
Our Privacy Policy explains how we collect and use information. By providing a phone number/email, you consent to service-related communications, including SMS (message/data rates may apply). Reply STOP to opt out of non-essential texts.
19) Force Majeure
We are not responsible for delays/failures caused by events beyond our reasonable control (e.g., severe weather, disasters, supply-chain disruptions, labor shortages, acts of government, utility outages).
20) Changes to These Terms
We may update these Terms from time to time. The Effective date above shows when changes took effect. Your continued use of the site/services after changes means you accept the updated Terms.
21) Governing Law & Venue
These Terms and any disputes are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Exclusive venue lies in the state and federal courts located in Miami-Dade County, Florida. You consent to personal jurisdiction there.
Optional: If you prefer binding arbitration and/or a class-action waiver, tell me and I’ll add a compliant clause.
22) Consumer Rights
Nothing in these Terms limits non-waivable rights you may have under applicable consumer protection laws.
23) Severability; No Waiver; Entire Agreement
If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms plus your written quote/invoice and our Privacy Policy constitute the entire agreement regarding the subject matter and supersede prior discussions.
